Constitutional Law 101: Difference between State and Private Actors on an Individuals right to Free Speech

A store policy is like a form of speech (commercial speech), as well as a limitation of the speech of customers. Wearing a mask is also considered speech. The store can force people to wear masks cause they are a private actor, but a state cannot ban masks cause they are a state actor, unless they had a rational basis for infringing on that person or private businesses rights. The store has the right to ban almost any speech, because you have first amendment right not to associate with that store. In contrast, you can't reasonably avoid the police powers of the municipality, state or federal government.

“We are the only country not opening schools. This is absurd,” he said. “Look at the science. I’m saying use critical thinking and logic.”

“You either believe the science or not,” he added. “You can’t insist that you believe in the science and then act contrary to science.”

 
People went crazy for Moderna stock after the New England Journal of Medicine published their findings of a 45 person safety study. It has the feel of sponsored content. Those immunology responses start to decline 30 days after the second dose among the test subjects in the safer, lower dose groups. With all the changes going on with the spike protein, I'm not too sure about relying on those vaccinations given some of the side effects and dropouts.
 
Cobb and Fulton Counties are going full digital to start. I feel bad for those seniors, from my eyes, I'd say it's 99.9% that they don't get to do in person school in their final year before college.

There's no way I'm going to believe that viruses do not spread faster on college campuses, where students are cramped in classrooms and dormitories. Describing college students as children was very cringe for me. There's no scientific basis for the claim that college students will be harmed by taking online classes or foregoing the entire semester.

As for public school children, there are actually familial concerns that could damage a child, particularly in single-parent households that need the school system to provide care while the mother/father earn income.
 
If Kemp goes after stores for mandating them that would be political suicide and deadly for Georgians.
I can't see that happening. This is not an endorsement but he's acting like a republican to the tee. Limited government involvement and rely on private industry and the individual to police themselves. I can't say I agree with him but he's doing what he said he would do. I don't agree with him overruling the counties and cities. He could have held to his principles and still let them do their thing.

Yep that area around Myrtle Beach is a hotspot in South Carolina. I'm going to add this to some of the anecdotal reports of spikes across the United States. Now that the Summer holiday season is over for beaches, it'll be interesting to watch the trends towards labor day. Basically, the spike is no longer sustainable.

It’s July 16, we aren’t done with the summer holiday season yet lol. Still have a good 30 days of beach bookings

Yeah, I kind of laughed when I read Kemp say that jurisdictions making masks mandatory is illegal, at this point it doesn't matter, you're going to need to take your masks with you because if you're in an area that made it mandatory, they're going to make it mostly mandatory to get in places, I think areas making it mandatory gives places the confidence to also do it, and you can be refused service easily.

I will say one thing that I WON'T be doing assuming we make it to early August...and it's wearing a mask outdoors in a state park. I know NC has made masks mandatory, but there isn't much way we follow that outdoors.

You’re only supposed to wear a mask in NC when unable to socially distance, which in most cases is possible outdoors. Personally, I never wear a mask outdoors unless I’m putting it on in the grocery store parking lot or something like that.

It’s still pretty bad. Slim pickings for rentals all of August. It’s because people were stuck in the house for so long and the fear of being quarantined again in the fall. I think this summer season will drag on way past normal at the coast and SE

With schools getting pushed back more and more people will be extending summer. Kids can go remotely while at the beach.

What's the survival rate? I'm sure it's close to 98%.

The CDC estimated fatality rate is 0.26%, so that would put the survival rate at 99.74%. It may indeed be as low as 99.5% in reality as 0.26% seems kind of low to me to be honest, but it’s also heavily stratified by age, where the fatality rate for a healthy 20-something is basically zero whereas it is probably 10%+ for someone over the age of 80 with health issues.

If this had a 2% fatality rate, that would be a very bad thing. Many millions would die in this country alone.

Sweden’s CFR is over 7%, but that’s far higher than the true fatality rate because of a lack of testing and mild/asymptomatic cases. It’s possible their true fatality rate is higher than ours because they got hit earlier when treatments weren’t as well developed, though. But 7% is still far too high for plausibility.

The remote schooling doesn't work very well. Some kids are better at it than others. The extroverts in my family really struggled with it. Some families with one working parent can't even do it. With 70% of black families being led by the mother only, for instance, it really hits some demographics harder than others.

We need to open schools in the fall.

That should put this hole issue to bed! Survival rate is even higher for people under 65. The general public doesn't need to do anything special for a virus with a 99.74% survival rate. Great news!

But no, the tyrants are just doubling down on freedom crippling mandates...

Wearing a mask is as much of a "freedom crippling" mandate as is wearing seat belt when you're driving a car.
